Terms of Service

1. Who these terms are for
These terms govern the use of Aperture (“the Service”) by photographers and studios (“you”, “the Photographer”) who create an account to sell photographs to their own customers (“Buyers”). The Service is operated by [LEGAL ENTITY NAME], [REGISTERED ADDRESS] (“we”, “us”). Buyers who purchase through a Photographer’s storefront are customers of that Photographer; their purchase is governed by the Photographer’s own terms and by the Buyer Notice in section 9.
2. Your account and your storefront
You must be at least 18 and able to enter into a contract. You are responsible for everything that happens under your account and on your storefront, including the photographs you upload, the access codes you distribute, and the prices you set. You confirm that you hold the rights and permissions needed to sell each photograph, including any consent required to photograph and sell images of minors in the schools, clubs and events you work with.
3. Payments, fees and payouts
Sales are processed by Stripe through a Stripe Connect account that you open and control. Each Buyer payment is a charge to your Stripe account. We collect a platform fee on each sale, as a percentage set by your plan and shown on our pricing page and in your studio billing settings; the fee is deducted from the charge by Stripe. Stripe’s own processing fees, your payout schedule and any chargebacks are governed by your agreement with Stripe. Subscription plans are billed monthly in advance and can be changed or cancelled from your billing settings; cancelling returns your account to the free tier at the end of the paid period.
4. Fulfilment and refunds
You are the seller of record. You fulfil print orders with the lab of your choice, deliver anything the storefront does not deliver automatically, and handle refunds and disputes with your Buyers. Digital downloads are made available to the Buyer immediately after a successful payment; you agree not to withdraw a Buyer’s access to files they have paid for except as part of a refund.
5. Content and acceptable use
You retain all rights to your photographs. You grant us a licence to store, resize, watermark and serve them solely to operate the Service for you. You will not upload content that is unlawful, that you do not have the right to sell, or that depicts people who have not consented to being photographed in the relevant context. You will not use the Service to send unsolicited messages, to probe or overload our systems, or to circumvent access controls on any storefront.
6. Buyer data
Buyer names, email addresses and order history are collected on your behalf so that you can fulfil orders and so Buyers can retrieve their purchases. You are the controller of that data; we process it under your instructions and our Privacy Policy. You agree to handle Buyer data lawfully and to respond to Buyers’ requests about their data.
7. Availability, changes and termination
We aim to keep the Service available but do not guarantee uninterrupted operation. We may change features with reasonable notice. You may close your account at any time; we may suspend or close accounts that breach these terms, with notice where practical. On closure we keep order records for as long as tax and accounting rules require and delete other content after a reasonable period, as described in the Privacy Policy.
8. Liability
The Service is provided as is. To the extent permitted by law, we are not liable for lost profits or indirect losses, and our total liability for any claim is limited to the subscription and platform fees you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
9. Buyer notice
If you are a Buyer: your purchase is from the Photographer named on the storefront, who is responsible for the photographs, the prints and any refund. Aperture provides the storefront and payment technology. Your download links are personal to your order; please do not share them.
10. Governing law and contact
